“PULSE February 2010 – March 2010 PROMOTION”

HOW TO ENTER

To be eligible to enter the draw, individuals who are members of the PULSE Rewards Program must present their PULSE Rewards card at the point of sale when they make a qualifying purchase at any store participating in the PULSE program between 19 February 2010 and 11:59pm AEDST on 31 March 2010. A qualifying purchase is defined as a purchase of $5.00 (AUD for Australian residents and NZD for New Zealand Residents) or more for existing and newly enrolled PULSE members.

With each qualifying purchase made, the entrant will receive a voucher containing a unique code. To enter the draw, entrants must, during the promotional period, visit www.pulserewards.com.au, follow the prompts to the competition entry page, input all requested details including the unique code found on the voucher and submit the fully completed entry form.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Entry is only open to Australian and New Zealand residents aged 18 years or older who are members of PULSE. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.

  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  4. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying purchase; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one (1) unique code per entry is permitted; (d) the same unique code cannot be used more than once; and (e) unrecognised codes will be deemed invalid.

  5. Incomplete or indecipherable entries will be deemed invalid.

  6. Promotion commences on 19 February 2010. Final entries must be received by 11:59pm AEDST on 31 March 2010. The draw will take place at Visible Results Australia Pty Ltd, 2C Hayes Rd Rosebery NSW 2018 on 12 April 2010 at 12pm AEST. Draw winners will be notified by phone and mail. The name of the Major Prize winner will be published in The Australian on 19 April 2010. The Promoter’s decision is final and no correspondence will be entered into.

  7. Major Prize: The first valid entry drawn from all entries received during the promotional period will win a trip for two (2) people to Byron Bay, Australia, valued at up to AUD$5,983, depending on date and point of departure. Major Prize consists of two (2) return economy flights from the winner's nearest Australian or New Zealand capital city to Ballina Byron Airport. If the winner’s nearest capital city is Brisbane or Gold Coast then return travel by coach will be arranged, instead of the return economy flights. Prize also includes airport transfers (or bus depot transfers, whichever is appropriate), five (5) nights accommodation for two (2) people at The Byron at Byron Resort and Spa, one (1) bottle of Bollinger Champagne on arrival, full buffet breakfast daily in the Restaurant at The Byron at Byron for two (2) people, one (1) Couples Indulgence Spa Experience in The Spa and Wellness Centre, one (1) five course degustation dinner with matching wines for two (2) in the Restaurant at The Byron at Byron, one (1) $150 credit to the resort Lobby Shop, one (1) $150 credit to use throughout the stay in the resort restaurant or poolside, one (1) complimentary yoga class for two (2) people and resort bicycle hire for two (2) throughout the stay. Additional spending money, taxes, additional meals, insurance, items of a personal nature, in-room charges and all other ancillary costs are not included. Travel is subject to availability at time of booking. Travel is not available during school holidays or peak holiday periods such as Christmas or Easter. Booking is subject to availability. Travel must be completed by 23 December 2010.

  8. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.

  9. Runner Up Prizes: The next two hundred and fifty (250) valid entries drawn from all entries received during the promotional period will win a yoga pass (see http://www.yogapass.com.au/findyogapass_frameset.htm for yoga pass locations). Each pass valued at AUD$20 each.

  10. If for any reason a winner does not take a prize or an element of the prize by the time stipulated by the Promoter, then that prize or that element of the prize will be forfeited.

  11. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  12. Total prize pool is up to AUD$10,983. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash

  13. A draw for any unclaimed prizes may take place on 3 August 2010 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by phone and mail and the winner of the Major Prize, if awarded, will have their name published in The Australian on 9 August 2010.

  14. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.

  18. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
